These Terms of Use ("Terms") govern your use of the TrueRatePath website and services operated by Pacific Credit Solutions ("TrueRatePath," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Description of Services

TrueRatePath is a consumer information and lead generation service that connects homeowners with licensed mortgage professionals. We display estimated property data and home equity information to help you understand potential borrowing options available through your home equity.

TrueRatePath is NOT a lender, mortgage broker, mortgage banker, or financial advisor. We do not make loans, offer credit, set interest rates, determine loan terms, or make lending decisions. We do not charge consumers any fees for our services. We are compensated by lending partners when we connect them with consumers.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use our services. By using our services, you represent that you meet these requirements and that the information you provide is accurate and complete.

3. No Offers of Credit

Nothing on the TrueRatePath website constitutes an offer or solicitation for a mortgage loan or any other financial product. All rates, terms, and product descriptions displayed on our site are for illustrative and informational purposes only. Actual rates, terms, and product availability are determined solely by lending partners based on your individual credit profile, property details, and other factors. Receipt of information through TrueRatePath does not constitute a pre-approval, pre-qualification, or commitment to lend.

4. Property Data Accuracy

Property valuations, equity estimates, and other real estate data displayed on our site are derived from public records and automated valuation models provided by third-party data sources (including ATTOM Data Solutions). This data is provided for informational purposes only and may not reflect current market conditions, recent improvements, or other factors that affect property value.

We make no warranty or guarantee regarding the accuracy, completeness, or timeliness of property data. Estimated home values are not appraisals. Estimated equity amounts are calculated using automated models and publicly recorded mortgage information, which may not reflect current mortgage balances, additional liens, or other encumbrances. Actual values may differ significantly from estimates shown.

5. Consent to Communications

When you click "Yes, that's me — show my options" or otherwise submit your information through our site, you provide your express written consent to be contacted by TrueRatePath and our lending partners via telephone calls (including calls using automatic dialing systems and prerecorded messages), text messages (SMS/MMS), and email at the phone number and email address associated with your application.

This consent is provided pursuant to the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable state laws. Your consent is not a condition of purchasing any product or service. You may revoke consent at any time by replying STOP to any text message, clicking unsubscribe in any email, or contacting us at privacy@trueratepath.com.

6. Home Equity Product Risks

Home equity products (including HELOCs, home equity loans, and cash-out refinances) are secured by your home. If you are unable to make payments on a home equity product, you may risk foreclosure and the loss of your home. Interest rates on certain products (such as HELOCs) may be variable and can increase over time. You should carefully consider whether a home equity product is appropriate for your financial situation.

We strongly recommend consulting with an independent financial advisor or housing counselor before entering into any home equity product. You may contact a HUD-approved housing counseling agency at no cost by calling (800) 569-4287 or visiting consumerfinance.gov/housing.

7. Third-Party Lending Partners

When we connect you with a lending partner, your interactions with that lending partner are governed by their own terms of use, privacy policy, and applicable regulations. TrueRatePath is not responsible for the actions, products, services, or representations of any lending partner. We do not endorse or guarantee any specific lending partner, product, or rate.

Our site may contain links to third-party websites, including personal loan comparison services. These links are provided for your convenience only. We do not control and are not responsible for the content, privacy practices, or terms of third-party sites. Accessing third-party sites is at your own risk.

9. Intellectual Property

All content on the TrueRatePath website, including text, graphics, logos, and software, is the property of Pacific Credit Solutions or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDINGPATH AND LIDO MEDIA GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, ANY LENDING DECISIONS MADE BASED ON INFORMATION PROVIDED THROUGH OUR SITE, OR ANY ACTIONS OF LENDING PARTNERS, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless TrueRatePath, Pacific Credit Solutions, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services or violation of these Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Orange County, California. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Modifications

We reserve the right to modify these Terms at any time. Changes become effective upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
